ImmutableThe Food Safety Modernization Act (FSMA) was signed into law on January 4, 2011. FDA then spent several years developing and finalizing the implementing regulations. The seven major FSMA rules were finalized between 2015 and 2023, with compliance dates staggered to give smaller businesses more time to come into compliance.
Most FSMA rules use a three-tier compliance schedule:
- Large businesses: Generally the first to comply (typically 1–2 years after the final rule publication)
- Small businesses: One additional year after large businesses (defined by number of employees or annual sales)
- Very small businesses: Two additional years after large businesses (defined by lower revenue thresholds)

Agricultural Water (Revised)
21 CFR Part 112, Subpart E (revised) — Final rule on pre-harvest agricultural water published 2024
- Large farms: 2026 (systems-based assessment for pre-harvest water)
- Small farms: 2027
- Very small farms: 2028–2029
- Harvest/post-harvest water: Original compliance dates remain in effect (already passed for most farms)
Status: Large farm compliance date approaching. Small and very small farm dates extend through 2029.
